Why tenders are disqualified for being non-responsive

One of the key reasons why tenders are getting disqualified, is that bidders are mostly under the impression, that by merely completing the tender forms, their bids would be considered as responsive.



Firstly, bids have to comply with the Terms and Conditions of Tender (TCTs), which is not to be confused with the General Conditions of Contract (GCCs).



The TCTs are clearly contained in the bid documents and it is not part of the qualifying criteria, should the latter, also be applicable in a specific tender.



Secondly, in order for a bid to be completely responsive, it has to be duly signed and initialed as well as attaching, the authority to sign the bid.



Thirdly, a bid has to comply with the requirements (goods or services), as well as the specifications, despite the possibility of deviation, which could be considered by the organ of the state, which is also different to that of an Alternative Offer or Alternative Bid, per se.



Fourthly, a bid has to comply with the submission requirements, which could include exact instructions for a two-envelope system, where the bidder will be required to place the correct tender forms, in each respective envelope.



Fifthly, in order to make a bid response, the tender has to be priced correctly, since the request for quotations (RFQs) and open bids have different thresholds both for local government entities and for those, that are categorised as provincial and national departments, state-owned-enterprises (SEOs) and others.



According to Gerrit Davids, Lead Advisor, TaranisCo Advisory, tendering agency, “It is imperative for bidders to understand the full criteria required to make their bids responsive. We’ve recently had a case where a bid was disqualified, simply because the bidder was not aware of the threshold amount for an RFQ, applicable to a national department.”



“It proves again that by merely placing a focus on completing the tender forms only, and not having knowledge of the applicable regulations, which governs tendering, bids that do not comply with it, will always be disqualified”, says Davids
