Kindly take note that recent developments around the score on your BBBEE Certificate may affect your standing within the tendering-evaluation process. The BBBEE Codes as issued in 2007 has targets, which are applicable from years 0-5 and from years 6-10 for the Employment Equity & Preferential Procurement elements, respectively

The new targets for years 6-10 are applicable to those businesses whose year-end was after 9 February 2012.
However, the DTI on 11 May 2012 issued a statement, which now indicates that there must be a reversal to the targets set for years 0-5. It says, “the dti is in the process of refining the Codes of Good Practice on B-BBEE and therefore the years 0-5 targets will be applied until the process of refining the code is finalised and gazetted. In the light of the aforementioned, the dti will withdraw the notice to eliminate the confusion in the market regarding the implementation of the years 6-10 targets and provide further guidance on the measurement date.”

In essence if you've conducted a BEE Audit and was issued with BBBEE Certificate after 9 February 2012, your scorecard will not reflect an assessment under the targets of years 0-5, but years 6-10. This statement is now causing all sorts of confusion since the question arises as to whether it carries any legal standing or not. However, assuming that you've scored higher points previously and now has a lower score under the "higher targets", you could quite rightly engage your verification agent on this statement as issued by the DTI.

Kindly also be advised that the BBBEE codes will be amended as early as July 2012 with major changes, which will affect your scorecard and its best to align your implementation to the expected changes.

The challenge with BEE is not "what score you've achieved, but to hold onto that score or even doing better next time around". More and more companies are losing out on tenders, even if they've offered the lowest price, but they are not awarded the contract due to their rating BEE being too low.
